SwishHost is a trading name of Swish World Group Inc, 271 W. Short St, Lexington, KY 40507.
1. Acceptance of these terms
By accessing the SwishHost website, creating an account, purchasing services, or otherwise using any SwishHost platform or service, you agree to be bound by these Terms of Service, together with any other policies, service-specific terms, or additional agreements that may apply.
2. Eligibility
You must be at least 18 years old to use our services, create an account, or enter into a binding agreement with us. By using SwishHost, you confirm that you meet this requirement and that you have the authority to act on behalf of any business or organization you represent.
3. Service availability and service area
This website is currently intended for the United States. Availability of particular services may vary depending on technical, geographic, commercial, regulatory, or operational factors. We may change, limit, or withdraw service availability at any time where reasonably necessary.
4. Accounts and customer responsibility
You are responsible for providing accurate, complete, and up-to-date information when creating an account, purchasing services, or managing your customer profile. We may use third-party payment processors, including Stripe, to process transactions. Payment processing may also be subject to the terms and policies of those providers.
7. Renewals and recurring services
Unless otherwise stated for a specific service, subscriptions and recurring services may renew automatically at the end of each billing period. By purchasing such services, you authorize recurring billing until cancellation, termination, or expiration in accordance with the applicable service terms.
8. Price changes
We may change pricing, fees, or service charges from time to time. Where reasonably applicable, we will provide notice before updated pricing takes effect for future billing periods. Price changes do not necessarily affect charges already invoiced or already paid.

Certain SwishHost services may rely on third-party providers, registries, payment processors, infrastructure platforms, external software, reseller systems, or integrations. Those services may be subject to separate third-party terms, technical limitations, availability conditions, or operational dependencies.
11. Service availability and support
We aim to provide reliable services and a professional customer experience, but we do not guarantee uninterrupted, error-free, or always-available service unless explicitly stated otherwise in a separate written service-level agreement or formal service commitment.
12. Backups and customer data responsibility
Unless expressly stated otherwise for a particular service, customers remain responsible for maintaining appropriate backups of their own websites, data, content, configurations, and other materials. You should not rely solely on SwishHost for backup, recovery, or data retention unless that is specifically included as part of the service.
13. Limitation of liability
To the fullest extent permitted by law, Swish World Group Inc and SwishHost shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, goodwill, or anticipated savings arising from or related to the use of the website or services.
To the fullest extent permitted by law, our total liability for claims arising out of or relating to the services shall be limited to the amount paid by you to us for the affected service during the relevant period giving rise to the claim.
14. No warranty
Except where expressly stated otherwise, services are provided on an “as available” and “as is” basis. We do not make warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except to the extent such disclaimers are not permitted by applicable law.
15. Governing law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
16. Changes to these terms
We may update these Terms of Service from time to time to reflect operational, legal, technical, or commercial changes. The latest version will be published on this page with an updated effective date where appropriate.
